As you may be aware
from reading other pages in this website the Sherforce team
will do all they can to execute your Writ and meet your
expectations of payment in full. You can help Sherforce
in a number of different ways in doing the following:
1.
Always ask for advice from the Sherforce Team
before you issue a Writ if you are unsure about
anything. We are very experienced and we can probably
settle any query you have and if need be save you
the Court fee if the case is hopeless.
2.
Check that the debtor is not Insolvent –
you can do this from free websites which are available
or from your own knowledge of the situation regarding
your debtor (however we will do this for you when
we receive your instruction anyway).
3.
Contact the Sherforce Team right away if you
become aware that there are any goods on particularly
such as cars, boats, caravans, aeroplanes, animals
or stock which the debtor is likely to move to avoid
payment. Early notification of potential removal
of goods to avoid payment will mean that Sherforce
will act more quickly to prevent a lost opportunity
for you. They will also discuss with you the cost
of impounding these items which may in some cases
be substantial to ensure the best outcome for you.
4.
Remember to provide Sherforce with as much information
about the debtor as you can. For example, a full
name and correct address, details of any goods the
debtor owns which might be levied on, the nature
of the debtor’s employment or business and
telephone numbers for the debtor are all vital pieces
of information which are used by the Sherforce Team
to establish contact and to levy on the right type
of goods.
5.
Check any inventory which is made available on
the Sherpa system yourself so that you are aware
of what the likely cost and difficulties might be
in removing these goods. For example heavy plant
or machinery may require mechanical lifts or need
to be sold onsite while animals will require stabling
and feeding and may need the attention of the vet.
Sherforce will tackle enforcement in all these situations
but there is a cost to be paid which in the first
instance Sherforce can look to the creditor to underwrite.
6.
Let your Client Relationship Manager know at once
if, and when, you receive any payments from the debtor
while the Writ is being executed to ensure that these
payments are credited to the Writ and also that the
right amount of fees is being discussed with the debtor.
7.
Make sure that you let your Client Relationship
Manager know the results of any application for a
Stay of the Writ or when judgment is set aside as
soon as the hearing has taken place so that again
Sherforce can take appropriate action.
8.
Diarise your system so that if you are accepting
a payment plan you seek the renewal of the Writ well
in advance if it is expiring. A Writ is valid for
one year from the date it is issued and if it needs
to be renewed then the application to the Court must
be made before it expires. If the Writ does expire
then you may lose your place in the queue of priority
with other creditors. Again your Client Relationship
Manager will help you with this but do make a diary
entry three months before the expiry date as a reminder
to be in touch about renewing your Writ.
